A defect is an issue with how Forensic OSINT itself handled the capture: a broken hash chain, a corrupted audit log, a malformed report that fails to meet standard evidentiary format requirements, or a chain of custody gap caused by a flaw in our software. It does not include issues unrelated to the platform: how the capture was used or presented in court, content that was authentic but disputed on other grounds, captures that were modified outside the platform after export, or evidentiary rulings based on the underlying content rather than the integrity of the capture.
The guarantee applies to captures made during an active subscription. If a capture made while you were a subscriber is later challenged in court, even years after your subscription ends, the guarantee still applies, provided the subscription was active at the time of the capture.

Yes. For agency engagements, the guarantees appear directly in your quote and are reaffirmed in the master service agreement. For solo annual subscriptions, the guarantees are part of the published terms of service that govern your subscription.
No. The guarantees are standard for every annual subscriber and cannot be waived or modified by either party. We don't sell "guarantee-free" subscriptions at a discount, and we don't accept agency procurement requests to remove or weaken these guarantees in exchange for other concessions.
The Court Confidence Guarantee continues to apply to all captures made during the ELITE period at the ELITE legal support level ($10,000 USD). Captures made after downgrading are covered at the Essential level. The Year-End Promise threshold is calculated based on your subscription level at the end of the year.
The guarantees attach to the active subscription, not to a specific organizational entity. If your agency reorganizes, merges, or transfers the subscription to a successor entity, the guarantees continue to apply to captures made during the subscription period.
