What counsel is usually asking for

An eIDAS qualified timestamp is a specific legal artefact under EU Regulation 910/2014. It is not the same thing as the timestamps already on Forensic OSINT reports.

A qualified electronic timestamp

An RFC 3161 timestamp issued by a Qualified Trust Service Provider listed on the EU Trusted List. EU counsel often know this as a marca temporale qualificata.

Presumption of date and integrity

Under eIDAS Articles 41 and 42, a qualified timestamp carries a legal presumption that the date is accurate and that the hashed data has not changed since that moment, unless someone proves otherwise.

The same legal object is recognised in all 27 EU member states plus Iceland, Liechtenstein, and Norway. Country of the timestamp authority is where it is supervised, not where it is valid.

What every capture already includes

Most investigations do not need a qualified timestamp. The standard package is built for investigators who have to explain what they saw.

Worth being precise about

A qualified timestamp is a strong date-and-integrity artefact. It is not a magic seal on the internet itself.

Not included in the standard plan

Essential and Elite already include hashing, signed PDFs, and timestamps. An eIDAS qualified timestamp is a paid add-on for the account, only if you require it.

We are not a Qualified Trust Service Provider

A qualified timestamp is issued by a QTSP on the EU Trusted List. Forensic OSINT does not issue qualified certificates.

What no capture tool can prove

No software can prove a live webpage was authentic before the investigator opened it. The page is served by someone else. What Forensic OSINT proves, and what a qualified timestamp proves, is the evidence from the moment of capture onward: this is what was on screen, hashed, and dated from then on.

Where data is stored

By default, captures are not stored in the EU. An eIDAS qualified timestamp does not change that. If your matter requires EU or on-network storage, options exist: Single Tenant Cloud and On-Premise.

Questions we get

Do I need this for a US, Canadian, UK, or Australian case?

Usually no. Those jurisdictions authenticate digital evidence through hashing, signed reports, chain of custody, and testimony. eIDAS is the EU framework. Contact us if you are unsure.

Is this on every capture?

Not unless the add-on is enabled on the account. Standard reports keep the timestamps already in the product. Once you add eIDAS, it applies to all future reports on that account.

How much is the add-on?

It is a small add-on fee for the entire account, quoted when you contact us. It is not billed per report.

Does a qualified timestamp make the evidence automatically admissible?

No. Courts still decide. It addresses the EU request for a qualified timestamp. It does not replace investigator testimony or the capture methodology.
